**Terms and Conditions for In-Home Houseplant Services**

These Terms and Conditions (hereinafter referred to as "Terms") govern the payment for in-home houseplant help and housework services (hereinafter referred to as "Services") provided by Chez Flora LLC (hereinafter referred to as "Company") to the client (hereinafter referred to as "Client"). By engaging the Company's Services, the Client agrees to be bound by these Terms. Please read them carefully.

**1. Payment Terms:**

1.1. Billing Cycle: The Services will be billed on a monthly basis, with the billing cycle commencing on the first day of each month and ending on the last day of the same month.

1.2. Advance Payment: Client agrees to make payment in advance for the upcoming month's Services. Payment must be received by the Company before the start of each billing cycle.

1.3. Payment Methods: The Company accepts payment via the following methods:
- Credit/debit card
- Check
- Venmo
- Any other payment method as agreed upon by the Client and the Company in writing.

1.4. Payment Confirmation: The Company will provide the Client with a payment confirmation via email or any other agreed-upon method upon successful payment processing.

**2. Service Charges:**

2.1. Service Fees: The Client agrees to pay the Company a service fee of $45 per hour for the Services as specified in the contract or invoice.

2.2. Rate Changes: The Company reserves the right to change the service fees upon thirty (30) days' written notice to the Client. Any changes in fees will only apply to the billing cycle following the notice period.

**3. Refund Policy:**

3.1. Two-Week Refund/Cancellation Policy: The Client has a two-week (14-day) cancellation policy, starting from the first day of the billing cycle, to request a refund of the advance payment for upcoming Services. Refund requests must be made in writing via email to chezflora.nika@gmail.com within this period.

**4. Termination:**

4.1. Termination by Client: The Client may terminate the Services at any time by providing written notice to the Company. Termination will be effective at the end of the current billing cycle. Refunds will not be given for services already provided (barring extreme circumstances discussed and agreed upon by the Company).

4.2. Termination by Company: The Company reserves the right to terminate the Services at its discretion upon providing the Client with fourteen (14) days' written notice.

**5. Late Payments:**

5.1. Late Fees: In the event of late payment, the Client agrees to pay a late fee as specified in the contract or invoice. 

**6. Privacy and Data Security:**

6.1. The Company will collect and store personal information as required to provide the Services. The Client's personal information will be handled in accordance with the Company's privacy policy, which can be found on the Company's website.

**7. Governing Law:**

7.1. These Terms shall be governed by and construed in accordance with the laws of Colorado and the United States, without regard to its conflict of law principles.

Plant Care Responsibility Clause
1.    Plant Care Commitment: The Company, Chez Flora LLC, commits to providing professional care and maintenance services for the houseplants owned by the Client. The Company's responsibility is to exercise reasonable skill, care, and diligence in preserving and enhancing the health and vitality of the plants.
2.    No Guaranteed Outcomes: While the Company will make every reasonable effort to ensure the well-being of the plants, it is important to acknowledge that houseplants, like any living organisms, can be subject to various factors that may affect their health, including but not limited to their existing condition, inherent plant vulnerabilities, environmental conditions, and unforeseen events.
3.    Limited Liability: The Company shall not be held liable for any loss, damage, deterioration, or death of the plants that may occur during the course of its care and maintenance services. This includes, but is not limited to, wilting, yellowing, leaf drop, pests, diseases, or any other adverse plant conditions.
4.    Notification of Issues: The Client agrees to promptly notify the Company of any visible or suspected plant issues, changes in plant condition, or concerns regarding the plant's health. Timely communication is essential to address and rectify any issues that may arise.
5.    Suggested Recommendations: The Company may offer recommendations and advice for the care and maintenance of the plants. These recommendations are provided in good faith, based on the Company's expertise, but the Client acknowledges that the ultimate responsibility for implementing these recommendations rests with them.
6.    Termination: The Client retains the right to terminate the plant care services agreement at any time, in accordance with the termination provisions outlined in this agreement. Upon termination, the Client is responsible for the ongoing care and well-being of the plants.
By entering into this agreement, the Client acknowledges and accepts the terms of this Plant Care Responsibility Clause, including the limitations of liability regarding the loss, damage, deterioration, or death of the plants under the Company's care.
